1. Parties

This agreement is made between the Leaser (Landlord/Property Manager) and the Lessee (prospective tenant) for the rental of the premises described above.

WHEREAS:

1. The Leaser is the legal owner or authorized manager of the said premises.
2. The Leaser is desirous of leasing and the Lessee is desirous of renting the premises at the rent and upon the terms and conditions hereinafter contained. Failure to comply with the conditions shall constitute a breach warranting a notice for immediate vacation.

NOW THIS AGREEMENT WITNESSES AND IT IS HEREBY MUTUALLY AGREED AND DECLARED AS FOLLOWS:

The Leaser agrees to lease to the Lessee the property unit located at Ngong, Ngong, specifically Unit 7, together with any fixtures, fittings, and amenities listed as part of this property.

• All Bedrooms are Ensuite

3. Terms and Conditions

1. The rent of the Premises shall be KSh 20,000.00 per month or part thereof or such other sum as shall be reviewed by the Leaser and agreed with the Lessee from time to time.
2. The Lessee has agreed and the Leaser has accepted to be paid the rent monthly payable in advance by the first day of each month.
3. Failure to comply with the preceding rent condition by the 15th day of the month shall necessitate a cancellation of this agreement and one (1) month's notice to vacate served.
4. The Lessee shall pay one (1) months' equivalent of refundable deposit to the Leaser, which shall be refunded upon termination of the Lease Agreement less only the rent owed by the Lessee to the Leaser.
5. The Lessee shall make good and reinstate any damage caused to the premises and repaint the interior of the apartment on vacating and that in case of failure to do so, the monies paid as deposit shall be utilized to repair damages and repaint the interiors before the balance is refunded to the Lessee.
6. Either party may serve the other a one (1) month's notice of intent/requirement to terminate this Agreement. However, in the event of a breach to these conditions, the notice shall be for immediate vacation.
7. This Agreement shall become effective and enforceable immediately upon execution.
8. In the event the Lease Agreement is terminated by either party, for whatever reason, prior to occupation of the Premises, the Lessee shall be entitled to only 75% refund from the Leaser of the rent received.
9. The Lessee shall at all times be of good neighbourliness and shall keep the premises in a desirable clean condition and shall use the rented Premises only for residence and not for any other purpose whatsoever.
10. Whereas, the leaser has provided security including watchmen and surveillance/warning devices (CCTV), the Lessee shall not, by residing at the Premises in any way compromise or cause to be compromised the security of the Premises.
11. The Lessee shall inform the Leaser of any defects or damages noted within the rented Premises as soon as they are identified.
12. To avoid overloading the Sewer Treatment Plant, laundry shall ONLY be washed in the laundry area and NOT in the shower rooms and no laundry water shall be disposed in the shower rooms or toilets. Additionally, the Lessee shall ensure that no sanitary towels or used contraceptive devices are disposed into the toilets or drainage system and that only appropriate tissue papers are flushed in the toilets.
13. The Lessee shall dispose all refuse/garbage generated from his/her house in the refuse collection room in sealed garbage collection bags. The Lessee will be responsible for the purchase of the bags at his/her expense. The Leasor will contract a garbage collection company to empty the garbage/refuse from the garbage collection room.
14. The Lessee will pay a service charge to cater for common services, including cleaning, guard services, external lighting, CCTV, Sewer Treatment costs, garbage collection and the like. This amount will be reviewed annually depending on the actual costs incurred.
15. The lessee shall pay his/her own water and electricity bills at the chargeable rates by the utility providers. The payments may be processed through the Leaser via installed sub-metering devices.
16. The Lessee shall not hang laundry on the building façade and instead will use the clothes drying lines on the roof. Additionally, the Lessee will utilize the drying lines in a responsible manner giving regard to the fact that these are shared with other tenants.
17. The Lessee shall only use the available infrastructure (sockets) to reticulate TV signals and wireless internet (Wi-Fi) and shall not create other routes for these without the express approval of the Leasor.
18. The Lessee shall not punch walls or make any alterations without the express approval of the Leasor.
19. Notwithstanding availability or otherwise of solar-heated water, the Lessee may request for installation of instant showers that will be installed by the Leasor at the expense of the Lessee.
20. The terms of this Agreement and the rent thereof shall be subject to review but in any case not earlier than the end of the initial lease term. The revised terms shall be executed by both the Lessee and the Leaser and shall become effective after 30 days of execution.
21. In the event there is a dispute on the interpretation of the terms or any clause of this Agreement, either party may serve the other one month's notice to terminate the Agreement without prejudice to or requirement for either party to alter the existing agreements in the intervening period.

6. Either party may serve the other a one (1) month's notice of intent/requirement to terminate this Agreement. However, in the event of a breach to these conditions, the notice shall be for immediate vacation.

8. In the event the Lease Agreement is terminated by either party, for whatever reason, prior to occupation of the Premises, the Lessee shall be entitled to only 75% refund from the Leaser of the rent received.
9. The Lessee shall at all times be of good neighbourliness and shall keep the premises in a desirable clean condition and shall use the rented Premises only for residence and not for any other purpose whatsoever.
10. Whereas, the leaser has provided security including watchmen and surveillance/warning devices (CCTV), the Lessee shall not, by residing at the Premises in any way compromise or cause to be compromised the security of the Premises.
11. The Lessee shall inform the Leaser of any defects or damages noted within the rented Premises as soon as they are identified.
12. To avoid overloading the Sewer Treatment Plant, laundry shall ONLY be washed in the laundry area and NOT in the shower rooms and no laundry water shall be disposed in the shower rooms or toilets. Additionally, the Lessee shall ensure that no sanitary towels or used contraceptive devices are disposed into the toilets or drainage system and that only appropriate tissue papers are flushed in the toilets.
13. The Lessee shall dispose all refuse/garbage generated from his/her house in the refuse collection room in sealed garbage collection bags. The Lessee will be responsible for the purchase of the bags at his/her expense. The Leasor will contract a garbage collection company to empty the garbage/refuse from the garbage collection room.
14. The Lessee will pay a service charge to cater for common services, including cleaning, guard services, external lighting, CCTV, Sewer Treatment costs, garbage collection and the like. This amount will be reviewed annually depending on the actual costs incurred.
15. The lessee shall pay his/her own water and electricity bills at the chargeable rates by the utility providers. The payments may be processed through the Leaser via installed sub-metering devices.
16. The Lessee shall not hang laundry on the building façade and instead will use the clothes drying lines on the roof. Additionally, the Lessee will utilize the drying lines in a responsible manner giving regard to the fact that these are shared with other tenants.
17. The Lessee shall only use the available infrastructure (sockets) to reticulate TV signals and wireless internet (Wi-Fi) and shall not create other routes for these without the express approval of the Leasor.
18. The Lessee shall not punch walls or make any alterations without the express approval of the Leasor.
19. Notwithstanding availability or otherwise of solar-heated water, the Lessee may request for installation of instant showers that will be installed by the Leasor at the expense of the Lessee.
20. The terms of this Agreement and the rent thereof shall be subject to review but in any case not earlier than the end of the initial lease term. The revised terms shall be executed by both the Lessee and the Leaser and shall become effective after 30 days of execution.
21. In the event there is a dispute on the interpretation of the terms or any clause of this Agreement, either party may serve the other one month's notice to terminate the Agreement without prejudice to or requirement for either party to alter the existing agreements in the intervening period.

This agreement is made between the Leaser (Landlord/Property Manager) and the Lessee (prospective tenant) for the rental of the premises described above.

WHEREAS:

1. The Leaser is the legal owner or authorized manager of the said premises.
2. The Leaser is desirous of leasing and the Lessee is desirous of renting the premises at the rent and upon the terms and conditions hereinafter contained. Failure to comply with the conditions shall constitute a breach warranting a notice for immediate vacation.

NOW THIS AGREEMENT WITNESSES AND IT IS HEREBY MUTUALLY AGREED AND DECLARED AS FOLLOWS:

The Leaser agrees to lease to the Lessee the property unit located at Ngong, Ngong, specifically Unit 8, together with any fixtures, fittings, and amenities listed as part of this property.

3. Terms and Conditions

1. The rent of the Premises shall be KSh 10,000.00 per month or part thereof or such other sum as shall be reviewed by the Leaser and agreed with the Lessee from time to time.
2. The Lessee has agreed and the Leaser has accepted to be paid the rent monthly payable in advance by the first day of each month.
3. Failure to comply with the preceding rent condition by the 15th day of the month shall necessitate a cancellation of this agreement and one (1) month's notice to vacate served.
4. The Lessee shall pay one (1) months' equivalent of refundable deposit to the Leaser, which shall be refunded upon termination of the Lease Agreement less only the rent owed by the Lessee to the Leaser.
5. The Lessee shall make good and reinstate any damage caused to the premises and repaint the interior of the apartment on vacating and that in case of failure to do so, the monies paid as deposit shall be utilized to repair damages and repaint the interiors before the balance is refunded to the Lessee.
